The present General Terms and Conditions govern the sale of Products by SAS Bonbonprint to its consumer and non-professional clients. According to their status as defined above, clients will refer to the conditions that apply to them.

For the purposes of these terms and conditions, and in accordance with the Consumer Code, the following definitions apply
consumer: any natural person who acts for purposes that do not fall within the scope of his commercial, industrial, craft, liberal or agricultural activity;
non-professional: any legal entity that does not act for professional purposes;
professional: any natural or legal person, public or private, who acts for purposes within the framework of his commercial, industrial, artisanal, liberal or agricultural activity, including when he acts in the name or on behalf of another Seller.

The BONBON-FRANCE.fr website is the property of SAS BBP (SIRET: 82847365200018, share capital: 45 000 €) registered in Clermont-Ferrand.

The products marketed by the company BONBON-FRANCE (hereinafter “BONBON-FRANCE”) are those visible on its website BONBON-FRANCE.com (hereinafter the “Products”).

Any order for Products placed by a natural person or a legal entity (hereinafter the “Customer”) implies unreserved acceptance by the latter of all the provisions of these general conditions of sale, which take precedence over any clause appearing in correspondence or legal and commercial documents of the Customer and in particular its general conditions of purchase, regardless of the time at which they are brought to the attention of BONBON-FRANCE

The data recorded by BONBON-FRANCE upon receipt of the Customer’s order constitute proof of all transactions. How to order : Orders will be placed exclusively on the website BONBON-FRANCE.com. To purchase a Product listed on the site BONBON-FRANCE.com the Customer must select the Product or Products that interest him and add it to his cart. To validate his order and proceed to the payment stage, the Customer must check and confirm the contents of his basket. He will then be redirected to a page summarizing the details of the Products he has selected, their price and delivery options, together with the relevant delivery charges. After placing your order, BONBON-FRANCE will send the Customer a confirmation email. The photographic representations that accompany the presentation of the Products on the site BONBON-FRANCE.com reproduce as accurately as possible said Products. However, these photos are not part of the contractual field and BONBON-FRANCE may be required to modify them without notice, particularly to improve their quality or remove them in case of supply shortage of certain materials.

In the event that a Product is no longer available, the Customer will be informed. In addition, BONBON-FRANCE reserves the right to cancel all or part of orders placed by a Customer in the event of orders for the same product placed in quantities too large, total unavailability of products, shortage of materials or failure of its suppliers and in all cases of force majeure. Customers will be informed of this and will be reimbursed for any amounts paid by bank transfer to the account used for the order.

Any order on the site BONBON-FRANCE.fr will become final upon electronic signature of the summary order of the Customer. The authentication procedure by “double-click” is an irrevocable acceptance of the Customer’s order, which can only be challenged within the limits provided in these conditions. This procedure allows authentication, non-repudiation and protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature, under the provisions of the Law of March 13, 2000 on electronic signature.

For non-customized Products:
Any “consumer” Customer within the meaning of consumer law has a right of withdrawal within a period of (14) days from the electronic signature of his online order. To exercise this right, the Customer must notify its decision to withdraw from the company BONBONPRINT clearly and unequivocally by any means (letter, fax or email).

The request for withdrawal exercised within the said period will result in the reimbursement of the costs incurred by the Customer when signing the order form. This refund will be made by transfer to the bank account used when placing the order.

For Products made at the request of the Customer or clearly personalized (product whose manufacture requires particular adaptations to meet precise technical and aesthetic requirements): the Customer does not profit from any right of retractation.

Any changes or cancellations of Product orders by the Customer shall only be taken into consideration by BONBON-FRANCE if they are received by registered letter with acknowledgement of receipt before the Products are shipped. For all Products, the prices are displayed in euros, including all taxes, as well as the applicable delivery charges (depending on the weight of the package, excluding packaging and gifts, the delivery address and the carrier or mode of transport chosen).
In particular, the prices include value added tax (VAT) at the rate applicable on the date of the order. Any change in the applicable rate may affect the price of the Products as of the effective date of the new rate.
The applicable VAT rate is expressed as a percentage of the value of the Product sold.
The applicable price is the one indicated on the BONBON-FRANCE Site on the date the order is placed by the Customer.

By placing an order on the site BONBON-FRANCE.fr, the Customer agrees to obtain the invoices of its purchases electronically. Electronic invoices will be made available in pdf format in the “Your account” space on the BONBON-FRANCE.fr website (account to be created before any order).

All orders over 120 euros including VAT will be archived by BONBON-France for a period of ten (10) years in accordance with Article L. 213-1 of the Consumer Code.

All payments must be made at the same time as the order. Payment for Products is made by credit card or Paypal payment on the website BONBON-FRANCE.fr. The Customer may choose to pay for his order in instalments when making his electronic payment. The Products will be shipped only after the Customer has received the amount due for the order.

As the Products are manufactured on demand, Customers will be informed by any means of the delays affecting their order. The announced deadlines are calculated in working days. The manufacturing and delivery dates provided by BONBONPRINT are given to the Customer as an indication only and are not binding on BONBONPRINT. Failure to comply with the dates of these deadlines shall not give rise to any right to damages, compensation, non-payment of the price of the Products delivered, or any other compensation of any kind to the Customer. If the manufacturing and delivery time exceeds thirty (30) days from receipt of the order by BONBONPRINT, the Customer may choose to maintain or cancel the order and may be reimbursed for the order by bank transfer to the account used for payment. BONBONPRINT undertakes, as far as possible, to dispatch all Products ordered by the Customer once they have been prepared, without incurring any liability or penalties as a result of late or incomplete dispatch. The unavailability of a Product resulting from a manufacturing interruption, shortage or any other circumstance, shall not affect the rest of the order, nor shall BONBONPRINT be liable in any way whatsoever.

The Products are delivered to the Customer at the address indicated by the latter at the time of his order: in metropolitan France (including Corsica and Monaco) or outside metropolitan France.

The Products are sold under reservation of ownership: the transfer of ownership is subject to full payment of the price in principal and interest by the Customer.

The Customer must systematically check the number of packages according to his order, and ensure the condition and content of the Products received at the time of their receipt. In case of shortages, damage, or any other incident, the Customer must formulate his detailed reserves on the transport receipt and confirm them to the carrier by registered letter with acknowledgement of receipt within three (3) days of delivery. The Customer must then immediately inform BONBON-FRANCE by sending a copy of the letter addressed to the carrier to enable it to exercise its remedies. Compliance with this procedure is mandatory in order to benefit from a possible right to reimbursement of the Products. In addition to the claims made to the carrier according to the procedure described in Article 10, any claim concerning the Products addressed to BONBON-FRANCE must be made by registered letter with acknowledgement of receipt within thirty (30) days from the date of receipt of the non-compliant or defective Products. The proof of the non-conformity of the received Products compared to its order belongs to the Customer. No Product may be returned without the prior written consent of BONBON-FRANCE, which may, at its discretion, either replace the Products or issue a credit note to the Customer for an amount equal to the price paid by the latter for the non-compliant or defective Products. In case of return of Products with the agreement of BONBON-FRANCE, the Customer must attach the shipping slip and the invoice. The cost of returning the Products shall be borne exclusively by the Customer when the latter is a professional under French law.

The Customer is reminded that in accordance with the provisions of Articles 1641 et seq. of the Civil Code, BONBONPRINT is the guarantor of hidden defects in the item sold. Proof of the hidden defect must be provided by the Customer who has a period of two (2) years from the discovery of the defect to take legal action. He may therefore request either the return of the item to the BONBONPRINT company and have the price returned, or the custody of the item with a return of part of the price.

The Products offered are in conformity with the French legislation in force and the standards applicable in France. BONBONPRINT shall not be held liable for any failure to comply with the laws of the country to which the Product is delivered. It is the Customer’s responsibility to check with the local authorities the possibilities of importing or using the ordered Products. The characteristics of the Products presented in French language will be authentic.

The Products are manufactured by BONBONPRINT in accordance with the instructions provided by the Customer in his order. BONBONPRINT does not monitor the rights of third parties with regard to the markings on the Products. Thus, the Customer agrees not to use, download, reproduce files, texts, data, photos or images, likely to contravene the rights of third parties such as intellectual property rights, image rights or any right relating to the protection of the privacy of others. The Customer declares to be the owner of all the intellectual property rights and authorizations necessary, on the images, names, logos, inscriptions, texts and on all the elements and contents affixed on the ordered Products. The Customer is solely responsible for any infringement of third party rights for unauthorized use of a third party’s right or image without their prior authorization. In the event of a claim or prosecution for unauthorized use of a third party’s right, the Customer shall bear all costs associated with such proceedings as well as all sentences that may be imposed.

BONBONPRINT will systematically refuse any order for Products containing the following elements: content that is vulgar, defamatory, insulting, obscene, racist or xenophobic, pornographic, illegal or likely to be illegal, inciting the consumption of alcohol or tobacco or, more generally, any element that is considered by the company BONBONPRINT as being contrary to morality and law, as well as to the values and interests of society BONBONPRINT. The refusal of BONBONPRINT to perform the service requested does not in this case any right to compensation from the Customer. If the Customer has already paid for his order, he will be reimbursed by bank transfer to the account used for payment.

When ordering, the Customer must declare on his honor to be of age or to have an authorization from the persons exercising parental authority (for minors over sixteen years old). BONBONPRINT shall not be held liable in the event that the Products are purchased by a person who does not meet the above conditions.

BONBON-FRANCE shall only be liable under the conditions of common law for direct material damage incurred by the Customer in connection with the execution of the order for Products. The liability of BONBONPRINT is capped at the amount invoiced by BONBONPRINT to the Customer for each order, for all damages combined. These limits of liability do not apply to personal injury. BONBONPRINT shall not be held liable for any damages whatsoever resulting from improper use of the Products. BONBONPRINT shall not be held liable for any delay in delivery for any reason attributable to the transport services responsible for the routing of orders and the delivery of Products.

The Customer is informed that, in the context of the management of operations relating to the contractual relationship with its Customers, personal data are processed by BONBON-FRANCE, as the controller in accordance with the French Data Protection Act No. 78-17 of January 6, 1978 as well as with the rules applicable as of May 25, 2018 pursuant to the European General Data Protection Regulation. The data processed is essential for this processing and is used by the services of BONBON-FRANCE and, where appropriate, its subcontractors and service providers, some of which may be located outside the EU. The data concerned is kept for the entire duration of the contractual relationship plus the legal limitation periods. In case of data transfer outside the EU, rules ensuring data protection and security have been put in place. The Customer benefits, under the conditions provided for by law, from a right of interrogation, access, rectification, portability, limitation of processing and opposition for legitimate reasons, as well as the right to define directives concerning the fate of his data after his death. In the event of a dispute, Customers may file a complaint with the CNIL, whose contact information is available at the following address: https://www.cnil.fr.

BONBONPRINT undertakes to respond as soon as possible. In order to optimize the treatment of the requests of the Customers, those are invited to indicate in their mail their name, first name, email with which they placed their order and the number of the concerned order.
